These Terms of Service ("Terms") govern your access to and use of the Summar AI website, mobile application, and related services (collectively, the "Service") provided by Summar AI ("we," "our," or "us"). By accessing or using the Service, you agree to be bound by these Terms.

Eligibility

You must be at least 13 years old to use the Service. If you are using the Service on behalf of a business or organization, you represent that you have the authority to bind that entity to these Terms, and references to "you" include that entity.

Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at support@summar.ai if you suspect any unauthorized access. We reserve the right to suspend or terminate accounts that violate these Terms.

Use of the Service

You may use the Service for lawful personal and professional purposes, including recording, transcribing, and summarizing meetings, calls, lectures, and documents. You agree not to use the Service to record individuals without their knowledge or consent where required by law; to distribute, reproduce, or resell the Service without authorization; to attempt to reverse engineer, scrape, or access the Service in any unauthorized way; or to engage in any activity that is illegal, harmful, or disruptive to other users or to our infrastructure.

Your Content

You retain full ownership of all recordings, transcripts, summaries, and other content you create using the Service. By using the Service, you grant us a limited, non-exclusive, royalty-free licence to process and store your content solely for the purpose of delivering the Service to you. We do not claim ownership of your content and will never use it for any purpose beyond operating the Service without your consent.

Subscriptions and Billing

Summar AI offers both free and paid subscription plans. Paid plans are billed on a monthly or annual basis as selected at checkout. All payments are processed securely through our third-party payment provider. If your payment fails or you cancel your subscription, your account will revert to the free plan at the end of the current billing period. You will retain access to your existing content but paid features will be restricted. We do not offer refunds for partial billing periods except where required by applicable law.

Intellectual Property

All rights in the Service, including its design, software, algorithms, and branding, are owned by Summar AI or its licensors. Nothing in these Terms grants you any right to use our trademarks, logos, or proprietary technology beyond what is necessary to use the Service as intended.

Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that transcripts and summaries will be completely accurate. Use of the Service is at your own risk.

Limitation of Liability

To the fullest extent permitted by applicable law, Summar AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, or business opportunities, arising from your use of or inability to use the Service, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising from these Terms shall not exceed the amount you paid us in the three months preceding the claim.

Changes to These Terms

We may update these Terms from time to time. We will notify you of any material changes by email or in-app notice at least 14 days before they take effect. Your continued use of the Service after that date constitutes your acceptance of the revised Terms.

Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Delaware.
